Would you care to define the difference between what you call a mixed drink 
and a cocktail?
Number of ingredients? See Martini. See Black Russian. Is Lemon,Lime & Bitters 
a forbidden |cocktail" ? 
Type of ingredients? See anything with juice or mixer.
Is a Cuba Libre a cocktail? Is a Tequila Sunrise? 

There are locations where the definition is enshrined in licensing law, but 
everyone realizes that's unworkable

Wouldn't you be disturbed if you wanted a particular drink, the ingredients 
were in front of you, but the 'tender refused to put them together for you?
