Well, there is such a thing as coming up with something brand new, and 
possibly only later finding out that it's already been done (even if then).

Many times I have seen one of my team-mates faces drop when they bring a new 
creation to me and I get to say "Yeah, not bad. That's a San Francisco with 
grenadine, what did you call it again?"

To take a crappy modern example, I can easily believe that the "Buttery 
Nipple" and the "Cocksucking Cowboy" were 'invented' in different places the 
year butterscotch liquer was widely released. To try and get either party to 
'credit' the 'original' won't get far. (I favour "Buttery Nipple" for two 
reasons ;-)

It may be ungracious to claim that many rip-offs or twists are intentionally 
disregarding their roots. It's NOT THAT HARD for a decent bartender to come up 
with mixes that make sense, and it's NOT THEIR FAULT if someone else has done 
the same already. The best you can ask is that they research a lot before 
publishing the new name... and even then despite the "prior art", I'd say they 
have the perogative to claim their original creation was original.
 
Whether it catches on, however is up to things beyond everyones control.
