im a server at a bbq joint, and my question is, do i legally have to tip the bar back? can i be fired or held responsible if i choose to tip him based on how much work he has actually done for me? reason i ask, my restaurant is making us (the servers) tip the bar back 2.5% which i believe is far too high. I've been in the industry for some time and normally I wouldn't question tipping but i believe at 2.5% the bar back should be granting my every wish and bussing every single table. This is not the case in my restaurant. I would say I bus / reset nearly every single table. The bar back is our "busser" and he will maybe wipe a table down for me or clear some glasses.. .i dont feel that is worth 18$ if i make 700 on sales... please tell me im not insane for thinking this and how to justify tipping 2.5%. We also tip based on our sales AKA being punished for doing my job and selling. I disagree with my boss about having to tip him so high bc clearly he knows hes going to get 2.5% NO MATTER WHAT which leaves him little to no incentive to actually do his job. So if i dont get tipped lets say 18% once i get my sales and do the math, i still have to tip the bar back his 2.5%... I am being held to the grind stone to try and sell and to hopefully not get stiffed or less than 20% tips bc i am still having to pay the bar back his flat rate EVEN tho he can do literally NOTHING outside of wiping down 1 - 3 tables and lifting 3 glasses off my table. Am i crazy for thinking this is unjust?
