I doubt it would ever be something that even goes to court. In Oregon, the 
OLCC would come in, see you do that, fine you, and put a nice black mark in 
your liquor license file. Get a few of these and you can have restrictions put 
on your establishment, or get shut down for a few days. I couldn't see anyone 
fighting the fine in court for fear of getting their license yanked.
