I know two people here in California that didn't even have the keys in the 
ignition.  The cops resoned (and got away with) figuring that there was no way 
they could have been sober to get where they were. ONe of them was in the 
middle of nowhere changing a tire, and the other had keys on the passenger 
seat while reading a map.  The legal limit here is .08. Both of these people 
blew under .1. The police established that there was no way they could have 
gotten to theplace where they were while below the limit since neither had any 
alchohol in the vehicle, so they must have driven while intoxicated.
