I see a couple of options coming your way. The first is to explain to him that 
they are not his tips to take, and that if he feels that he deserves tips he 
should speak to someone about implementing a policy with a set percentage or 
at the very least, you should decide what to tip him out like any other staff 
person.  Another key issue is that if he is going to be tipped out, he should 
not have access to the money by changing them out for you.

Another option is to speak with one of the owners about the issue.

Another option is to call the cops or file a lawsuit. He's taking your money.  
From the sounds of it, their is no policy at the establishment entitling him 
to any money.

I think you need to argue this one, He's getting paid a salary and should not 
be included in the tips for the night.
