As an added note - you can trademark a name. In Australia the Illusion 
cocktail as become a registered trademark of Midori (Suntory). In effect, this 
makes it harder for others to profit from using the name but, even then, does 
not stop every bar in the country listing it on their cocktails lists - minus 
the TM.
I believe the cocktail name 'Hand Greade' is also a registered trademark.
There's my 2c worth.
