The only way you could be sued is if you made a plastic container similar to 
theirs, but no drink recipe can be trade marked.

I believe you already new this, but others may not.

I just helped the manufacturer of a drink shaker, which he manufactured with 
recipes on the outer shell of the shaker. He was harrased and threatened for 
using the name Stardust with his own recipe and Ray Gun and recipe.  I showed 
him where the name Stardust existed on four other websites and the exact 
recipe with the name Ray Gun already existed on another website.

2 parts 151
1 part everclear
1 Part Melon Schnapps
1 Part pineapple juice
sweet and sour mix, served over Ice in an 8 ounce glass)

Hand Grenade 

1 Pineapple, Chunks 
1 Part Vodka 
1 Part Mountain Dew

Mix roughly equal parts(or, to taste) of each. Let sit in a fridge overnight. 
When you want to drink it, put one chunk of pineapple in a shot glass, then 
fill with mixture. To drink properly, take pineapple in your teeth from shot 
glass, eat, then chase with shot. It's called hand grenade for three reasons: 
1) Hand grenades are often called pineapples. 2) You "pull the pin" with your 
teeth, as some people do with gernades. 3) You get blasted... :0)

But if you're ready for a drink that packs a serious punch, Tropical Isle is 
your destination. At this spot, the cocktail of choice is the Hand Grenade, 
which the bar has dubbed "New Orleans' most powerful drink." "It's strong and 
it's melon-flavored," says co-owner Pam Fortner. It's served in a 16-oz. 
signature cup or a half-yard--a tall, narrow glass generally used for 
beer--shaped like a hand grenade, and each drink comes with a toy hand grenade 
floating in it. "Adults like toys," Fortner confides.

I personaly don't think it's a good idea to serve people drinking alcohol any 
type of toy, god knows what things they will think of doing with them after a 
few drinks.
